SC extends Hindu daughters’ rights over parental property

Daughters would have rights over parental property even if the coparcener—equal share in rights to inheritors--had died before the date when Hindu Succession (Amendment) Act 2005 came into being, the Supreme Court announced in a major judgment today.

Three-judge bench of the Supreme Court today pronounced the judgment on a clutch of petitions, questioning if the 2005 Hindu Succession Act could prevail even on a restrospective basis.

"Daughters must be given equal rights as sons, Daughter remains a loving daughter throughout life. The daughter shall remain a coparcener throughout life, irrespective of whether her father is alive or not," Justice Arun Mishra was quoted as saying by Livelaw.
