SC extends Hindu daughters’ rights over parental property





Daughters would have rights over parental property even if the coparcener—equal share in rights to inheritors–had died before the date when Hindu Succession (Amendment) Act 2005 came into being, the Supreme Court announced in a major judgment today.

Three-judge bench of the Supreme Court today pronounced the judgment on a clutch of petitions, questioning if the 2005 Hindu Succession Act could prevail even on a restrospective basis.

“Daughters must be given equal rights as sons, Daughter remains a loving daughter throughout life. The daughter shall remain a coparcener throughout life, irrespective of whether her father is alive or not,” Justice Arun Mishra was quoted as saying by Livelaw.
